Mitherium User Agreement

License agreement for using the Mitherium website, applications, games, web services and for purchasing digital goods. Please read this document carefully before using any Mitherium services.

1. General Provisions

This User Agreement and license agreement sets out the terms of use for the website mitherium.com, applications, games, web services, personal accounts, stores, materials, software and digital products of Mitherium, collectively referred to as the "Services".

The Agreement is concluded between any person using the Services, referred to as the "User", and Individual Entrepreneur Stepan Sergeevich Blokhin, OGRNIP 317325600060062, INN 325002548240, referred to as the "Rights holder".

Use of the Services, account registration, installation of an application, payment initiation, purchase of a digital product or continued use of the website means full and unconditional acceptance of this Agreement. If the User does not accept the terms in full, the User must stop using the Services.

This Agreement and all relations connected with the use of the Services are governed by the laws of the Russian Federation. Claims and disputes are considered at the location of the Rights holder unless mandatory law provides another procedure.

2. Rights to Services and Materials

Exclusive rights to the Services, applications, games, software code, databases, interfaces, design, texts, images, the Mitherium logo, game titles and other intellectual property objects belong to the Rights holder or are used by the Rights holder legally.

Any commercial use of the logo, names, materials, source code, game assets, interfaces or other Mitherium elements without written consent of the Rights holder is prohibited.

3. Terms of Use

The Rights holder grants the User a simple, non-exclusive, non-transferable license to use the Services according to their direct functional purpose for personal non-commercial use, unless otherwise stated in a separate agreement, order, tariff or product description.

The User may view the website, use available web services, install applications, launch games, register a personal account, place orders, contact support and purchase digital goods within the functionality of a particular Service.

Some Services require Internet access. The User independently obtains and pays for such access under the terms of the User's telecom operator or Internet provider.

4. Restrictions

The User may not, without written consent of the Rights holder:

  • modify, decompile, disassemble, decrypt or otherwise examine object code of the Services;
  • create derivative works based on Mitherium applications, games, websites, interfaces, logos, assets or materials;
  • distribute the Services in modified form or under another name;
  • use the Services to violate Russian law, third-party rights, payment system rules or this Agreement;
  • post malicious code, spam, false data, unlawful materials or content that violates third-party rights;
  • bypass technical restrictions, security mechanisms, authorization, payment scenarios or account protection.

5. Account and Support

Access to certain functions may require registration. The User is responsible for the accuracy of submitted data and for keeping login, password, email, payment data and account actions secure.

All actions performed through the User's account are considered to have been performed by the User unless proven otherwise.

The Rights holder may restrict, suspend or terminate the User's access to the Services if the User violates law, this Agreement, payment rules, security requirements or third-party rights.

6. Digital Goods and Paid Features

The User may have access to paid digital goods, in-game currency, bonuses, subscriptions, access rights, studio services, improvements, consultations and other paid features. The main product catalog is available at https://mitherium.com/product-list/.

Payment may be processed through YooKassa and other payment tools connected to a particular Service. Product description, price, contents, delivery method and available payment methods are specified on the product, store or payment scenario page.

A digital good is deemed provided after successful payment and technical delivery of access, in-game currency crediting, feature activation, file delivery, service result delivery or another action matching the product description.

Refunds, cancellations and payment claims are considered under Russian law, payment operator rules, the description of a specific product and published refund terms. If a digital good has been fully provided and has no technical defect, refunds may be limited where permitted by law.

7. Personal Data and Technical Information

By using the Services, the User consents to the processing of personal data and technical information for access provision, registration, order fulfillment, payment processing, support, security, notifications and improvement of the website and applications.

The Services may automatically receive technical data: device type, operating system, application version, IP address, browser information, interface actions, security events, payment statuses and other information required for the product to work.

8. Liability

The Services are provided "as is". The Rights holder does not guarantee that the website, applications, games, payment scenarios, accounts, stores or individual functions will operate without errors or interruptions or fully meet the User's expectations.

The Rights holder is not liable for inability to use the Services caused by network failures, hosting failures, payment system failures, User devices, third-party platforms, app stores, actions of third parties or force majeure.

The User is solely responsible for the content, correctness and legality of data that the User transfers, publishes, uploads or uses in the Services.

9. Updates and Changes

This Agreement applies to all subsequent updates, new versions, improvements, components, website sections, applications, games, services and stores of Mitherium unless separate terms are published for them.

The Rights holder may change the Services, release updates, temporarily suspend access for maintenance, change feature composition, close sections and discontinue product support without prior consent of the User.

The Rights holder may amend this Agreement unilaterally. The current Russian edition is published at https://mitherium.com/useragreement/. This English edition is published at https://mitherium.com/user-agreement-en/. Changes take effect on the publication date unless the new edition states otherwise.

This English version is provided for convenience and mirrors the Russian version in substance. In case of differences in interpretation, the Russian version and the mandatory rules of Russian law prevail.
